Notice is hereby given that the Scurry County Commissioner's Court will hold a Public Hearing in the County Courtroom, located on the 3rd floor of the Scurry County Courthouse, on the 6th day of October 2026, at 10:00 a.m. to consider lowering the speed limit on CR 395, CR 3116 and CR 384 , or portions thereof, and approving the erection of new speed limit signs and other appropriate signage.

PURSUANT TO TEXAS TAX CODE CHAPTER 312, THE SCURRY COUNTY COMMISSIONERS COURT HEREBY GIVES NOTICE THAT IT WILL CONDUCT A PUBLIC HEARING AT THE REGULARLY SCHEDULED MEETING OF THE COURT TO BE HELD ON OCTOBER 6, 2026, AT 10:00 A.M., AT THE SCURRY COUNTY COURTHOUSE, 1806 25TH ST, SNYDER, TEXAS 79549, CONCERNING THE APPROVAL OF A TAX ABATEMENT AGREEMENT WITH FRACTAL POWER INC., THE APPLICANT AND OWNER OF A BATTERY ENERGY STORAGE SYSTEM.
THE PROPOSED AGREEMENT WOULD PROVIDE FOR A TAX ABATEMENT FOR PROPERTY LOCATED WITHIN THE SNYDER BESS REINVESTMENT ZONE #1, AS PREVIOUSLY DESIGNATED BY ORDER OF THE SCURRY COUNTY COMMISSIONERS COURT. THE PARTICULAR PROPERTY SUBJECT TO ABATEMENT COMPRISES APPROXIMATELY 2 ACRES LEASED OUT OF A 7.014-ACRE PARCEL LOCATED AT 800 37TH ST, SNYDER, TEXAS 79549, IN UNINCORPORATED SCURRY COUNTY (SCURRY COUNTY APPRAISAL DISTRICT PARCEL ID 19931). THE PROPOSED IMPROVEMENTS SUBJECT TO THE AGREEMENT COMPRISE A 9.9 MW (AC) BATTERY ENERGY STORAGE SYSTEM, AT AN ESTIMATED COST OF $3,400,000.

Notice of Consideration of Tax Abatement Agreement
Provided Pursuant to Texas Tax Code Section 312.402 and 312.207

NOTICE IS HEREBY GIVEN that, in accordance with the Government Code, Chapter 551, (known as the Open Meetings Act), as amended, a REGULAR MEETING OF THE COMMISSIONERS COURT, the governing body of Scurry County, will be held on the Tuesday, the sixth day of October, 2026 at 10:00 a.m. in the County Courtroom, located on the 3rd floor of the Scurry County Courthouse, at which time, the subjects below will be considered and potentially acted upon.
1. Hold public hearing on Scurry County’s intent to enter into a Tax Abatement Agreement with Energy Vault, Inc. relating to a Data Center Project.
a) Owner of property: The Owner of the Improvements and Additions (defined below) that would be subject to the Tax Abatement is Energy Vault, Inc. (Cross Trails Data Center) located at 4165 E. Thousand Oaks Blvd., #100, Thousand Oaks, CA 91362.
b) Applicant for Abatement: Energy Vault, Inc. (Cross Trails Data Center) located at 4165 E. Thousand Oaks Blvd., #100, Thousand Oaks, CA 91362.
c) Name and location of the Reinvestment Zone: Scurry County/Camp Springs Road #1 Reinvestment Zone; All the Northwest Quarter (NW/4) of Section No. 15 in Block No. 3, of the H&TC Ry. Co. Survey, Scurry County, Texas, containing 160 acres, more or less.
d) Improvements and Additions:

Notice of Consideration of Tax Abatement Agreement
Provided Pursuant to Texas Tax Code Section 312.402 and 312.207

The Commissioners Court of Scurry County, Texas will consider the possible approval of a proposed tax abatement agreement for certain real property and business personal property with SB Energy at a regularly scheduled Commissioners Court meeting on or after Tuesday, the 6th day of October 2026, at 10 a.m. in the Commissioners Courtroom on the 3rd Floor of the Scurry County Courthouse at 1806 25th Street, Snyder, Texas 79549.
1. The names of the applicants for tax abatement are Scurry County DC, LLC, and SE DC Gen, LLC. The names of the real property owners are Lisa M. Crump, Leslie Dukes, and Billie Bright.
2. The name of the Reinvestment Zone in which the property subject to the agreement is located is Scurry County Cavender Road Reinvestment Zone #1 (the “Reinvestment Zone”).
3. The location of the Reinvestment Zone is approximately 1,975 acres located at:
• APN: 169320/169321/169322: 550 acres of the 640 acres of Section 189, Block 97, H&TC Ry. Co. Survey, Scurry County, Texas;
• APN: 23491: 200 acres of the 644 acres of the Southern part Section 172, Block 97, H&TC Ry. Co. Survey, Scurry County, Texas;
• APN: 169324, 169325, 169326: Approximately 406-acre portion in the South half, save and except a 2-acre tract, of Section 190, Block 97, H&TC RY Co. Survey, Scurry County, Texas;
• APN: 23492: 203 acres of the East half of Section 173, Block 97, H&TC RY Co. Survey, Scurry County, Texas;
4. A general description of the nature of the improvements included in the tax abatement agreement follows: (i) one or more data centers and related improvements; (ii) other buildings and ancillary facilities supporting the operation of the data center or centers, (iii) such additional related improvements, including, but not limited to, required parking, landscaping and all other improvements; and (iv) computer servers and other equipment related to the operation of the data center or centers.
5. The estimated cost of the improvements described above is at least $1 billion dollars.

Approval by Governing Body

(a)

To be effective, an agreement made under this subchapter must be approved by the affirmative vote of a majority of the members of the governing body of the municipality or other taxing unit at a regularly scheduled meeting of the governing body.

(b)

On approval by the governing body, an agreement may be executed in the same manner as other contracts made by the municipality or other taxing unit.

(c)

In addition to any other requirement of law, the public notice of a meeting at which the governing body of a municipality or other taxing unit will consider the approval of a tax abatement agreement with a property owner must contain:

(1)

the name of the property owner and the name of the applicant for the tax abatement agreement;

(2)

the name and location of the reinvestment zone in which the property subject to the agreement is located;

(3)

a general description of the nature of the improvements or repairs included in the agreement; and

(4)

the estimated cost of the improvements or repairs.

(d)

The notice of a meeting required by this section must be given in the manner required by Chapter 551 (Open Meetings), Government Code, except that the notice must be provided at least 30 days before the scheduled time of the meeting.

Time and Accessibility of Notice; General Rule

(a)

The notice of a meeting of a governmental body must be posted in a place readily accessible to the general public at all times for at least 72 hours before the scheduled time of the meeting, except as provided by Sections 551.044-551.046.

(b)

If this chapter specifically requires or allows a governmental body to post notice of a meeting on the Internet:

(1)

the governmental body satisfies the requirement that the notice must be posted in a place readily accessible to the general public at all times by making a good-faith attempt to continuously post the notice on the Internet during the prescribed period;

(2)

the governmental body must still comply with any duty imposed by this chapter to physically post the notice at a particular location; and

(3)

if the governmental body makes a good-faith attempt to continuously post the notice on the Internet during the prescribed period, the notice physically posted at the location prescribed by this chapter must be readily accessible to the general public during normal business hours.

A county governmental body shall post notice of each meeting on a bulletin board at a place convenient to the public in the county courthouse.

Additional Posting Requirements for Certain Municipalities, Counties, School Districts, Junior College Districts, Development Corporations, Authorities, and Joint Boards

(a)

This section applies only to a governmental body or economic development corporation that maintains an Internet website or for which an Internet website is maintained. This section does not apply to a governmental body described by Section 551.001 (Definitions)(3)(D).

(b)

In addition to the other place at which notice or an agenda of a meeting is required to be posted by this subchapter, the following governmental bodies and economic development corporations must also concurrently post notice of a meeting and the agenda for the meeting on the Internet website of the governmental body or economic development corporation:

(1)

a municipality;

(2)

a county;

(3)

a school district;

(4)

the governing body of a junior college or junior college district, including a college or district that has changed its name in accordance with Chapter 130 (Junior College Districts), Education Code;

(5)

a development corporation organized under the Development Corporation Act (Subtitle C1, Title 12, Local Government Code);

(6)

a regional mobility authority included within the meaning of an “authority” as defined by Section 370.003 (Definitions), Transportation Code;

(7)

a joint board created under Section 22.074 (Joint Board), Transportation Code; and

(8)

a district or authority created under Section 52, Article III, or Section 59, Article XVI, Texas Constitution.

(c)

Repealed by Acts 2023, 88th Leg., R.S., Ch. 855 (H.B. 3440), Sec. 2, eff. September 1, 2023.

(d)

The validity of a posted notice of a meeting or an agenda by a governmental body or economic development corporation subject to this section that made a good faith attempt to comply with the requirements of this section is not affected by a failure to comply with a requirement of this section that is due to a technical problem beyond the control of the governmental body or economic development corporation.

About Scurry County
Scurry County is located in west-central Texas, known for its rich history and contributions to the state's development. Established in 1876 and organized in 1884, the county was named after William R. Scurry, a Confederate general in the Civil War. Its seat, Snyder, became a focal point for settlement due to its proximity to Clear Fork of the Brazos River and a convenient location for ranching and trade. Early inhabitants included Native American tribes such as the Comanches, who thrived in the region until the late 19th century when settlers and military campaigns pushed them out.

The county's history is deeply tied to its cattle ranching heritage. In the late 19th century, vast open ranges made Scurry County ideal for cattle grazing, attracting settlers seeking new opportunities in the rugged Texas landscape. The development of the railroad further spurred growth, allowing for the transportation of cattle and goods to markets across the state and beyond. By the early 20th century, oil discoveries transformed the county’s economy, bringing an influx of workers and industry. Snyder became a boomtown during the 1950s due to the discovery of the Canyon Reef oil field, one of the largest at the time.

Today, Scurry County reflects a blend of its historical roots and modern developments. While agriculture and energy production remain vital to its economy, the county also celebrates its history through museums, local festivals, and preserved historical landmarks. The rich cultural heritage and resilience of the people make Scurry County a unique and integral part of Texas history.
