PURSUANT TO TEXAS TAX CODE CHAPTER 312, THE SCURRY COUNTY COMMISSIONERS COURT HEREBY GIVES NOTICE THAT IT WILL CONDUCT A PUBLIC HEARING AT THE REGULARLY SCHEDULED MEETING OF THE COURT TO BE HELD ON OCTOBER 6, 2026, AT 10:00 A.M., AT THE SCURRY COUNTY COURTHOUSE, 1806 25TH ST, SNYDER, TEXAS 79549, CONCERNING THE APPROVAL OF A TAX ABATEMENT AGREEMENT WITH FRACTAL POWER INC., THE APPLICANT AND OWNER OF A BATTERY ENERGY STORAGE SYSTEM.
THE PROPOSED AGREEMENT WOULD PROVIDE FOR A TAX ABATEMENT FOR PROPERTY LOCATED WITHIN THE SNYDER BESS REINVESTMENT ZONE #1, AS PREVIOUSLY DESIGNATED BY ORDER OF THE SCURRY COUNTY COMMISSIONERS COURT. THE PARTICULAR PROPERTY SUBJECT TO ABATEMENT COMPRISES APPROXIMATELY 2 ACRES LEASED OUT OF A 7.014-ACRE PARCEL LOCATED AT 800 37TH ST, SNYDER, TEXAS 79549, IN UNINCORPORATED SCURRY COUNTY (SCURRY COUNTY APPRAISAL DISTRICT PARCEL ID 19931). THE PROPOSED IMPROVEMENTS SUBJECT TO THE AGREEMENT COMPRISE A 9.9 MW (AC) BATTERY ENERGY STORAGE SYSTEM, AT AN ESTIMATED COST OF $3,400,000.

Notice of Consideration of Tax Abatement Agreement

NOTICE IS HEREBY GIVEN that, in accordance with the Government Code, Chapter 551, (known as the Open Meetings Act), as amended, a REGULAR MEETING OF THE COMMISSIONERS COURT, the governing body of Scurry County, will be held on the Tuesday, the sixth day of October, 2026 at 10:00 a.m. in the County Courtroom, located on the 3rd floor of the Scurry County Courthouse, at which time, the subjects below will be considered and potentially acted upon.
1. Hold public hearing on Scurry County’s intent to enter into a Tax Abatement Agreement with Energy Vault, Inc. relating to a Data Center Project.
a) Owner of property: The Owner of the Improvements and Additions (defined below) that would be subject to the Tax Abatement is Energy Vault, Inc. (Cross Trails Data Center) located at 4165 E. Thousand Oaks Blvd., #100, Thousand Oaks, CA 91362.
b) Applicant for Abatement: Energy Vault, Inc. (Cross Trails Data Center) located at 4165 E. Thousand Oaks Blvd., #100, Thousand Oaks, CA 91362.
c) Name and location of the Reinvestment Zone: Scurry County/Camp Springs Road #1 Reinvestment Zone; All the Northwest Quarter (NW/4) of Section No. 15 in Block No. 3, of the H&TC Ry. Co. Survey, Scurry County, Texas, containing 160 acres, more or less.
d) Improvements and Additions:

Notice of Consideration of Tax Abatement Agreement

The Commissioners Court of Scurry County, Texas will consider the possible approval of a proposed tax abatement agreement for certain real property and business personal property with SB Energy at a regularly scheduled Commissioners Court meeting on or after Tuesday, the 6th day of October 2026, at 10 a.m. in the Commissioners Courtroom on the 3rd Floor of the Scurry County Courthouse at 1806 25th Street, Snyder, Texas 79549.
1. The names of the applicants for tax abatement are Scurry County DC, LLC, and SE DC Gen, LLC. The names of the real property owners are Lisa M. Crump, Leslie Dukes, and Billie Bright.
2. The name of the Reinvestment Zone in which the property subject to the agreement is located is Scurry County Cavender Road Reinvestment Zone #1 (the “Reinvestment Zone”).
3. The location of the Reinvestment Zone is approximately 1,975 acres located at:
• APN: 169320/169321/169322: 550 acres of the 640 acres of Section 189, Block 97, H&TC Ry. Co. Survey, Scurry County, Texas;
• APN: 23491: 200 acres of the 644 acres of the Southern part Section 172, Block 97, H&TC Ry. Co. Survey, Scurry County, Texas;
• APN: 169324, 169325, 169326: Approximately 406-acre portion in the South half, save and except a 2-acre tract, of Section 190, Block 97, H&TC RY Co. Survey, Scurry County, Texas;
• APN: 23492: 203 acres of the East half of Section 173, Block 97, H&TC RY Co. Survey, Scurry County, Texas;
4. A general description of the nature of the improvements included in the tax abatement agreement follows: (i) one or more data centers and related improvements; (ii) other buildings and ancillary facilities supporting the operation of the data center or centers, (iii) such additional related improvements, including, but not limited to, required parking, landscaping and all other improvements; and (iv) computer servers and other equipment related to the operation of the data center or centers.
5. The estimated cost of the improvements described above is at least $1 billion dollars.

(b)
On approval by the governing body, an agreement may be executed in the same manner as other contracts made by the municipality or other taxing unit.

Time and Accessibility of Notice; General Rule
(a)
The notice of a meeting of a governmental body must be posted in a place readily accessible to the general public at all times for at least 72 hours before the scheduled time of the meeting, except as provided by Sections 551.044-551.046.
(1)
the governmental body satisfies the requirement that the notice must be posted in a place readily accessible to the general public at all times by making a good-faith attempt to continuously post the notice on the Internet during the prescribed period;
(2)
the governmental body must still comply with any duty imposed by this chapter to physically post the notice at a particular location; and
(3)
if the governmental body makes a good-faith attempt to continuously post the notice on the Internet during the prescribed period, the notice physically posted at the location prescribed by this chapter must be readily accessible to the general public during normal business hours.

(a)
This section applies only to a governmental body or economic development corporation that maintains an Internet website or for which an Internet website is maintained. This section does not apply to a governmental body described by Section 551.001 (Definitions)(3)(D).
(4)
the governing body of a junior college or junior college district, including a college or district that has changed its name in accordance with Chapter 130 (Junior College Districts), Education Code;
(8)
a district or authority created under Section 52, Article III, or Section 59, Article XVI, Texas Constitution.
(d)
The validity of a posted notice of a meeting or an agenda by a governmental body or economic development corporation subject to this section that made a good faith attempt to comply with the requirements of this section is not affected by a failure to comply with a requirement of this section that is due to a technical problem beyond the control of the governmental body or economic development corporation.
