Part 105: Names, Images, and Colors Are Also Labeling—How Packaging Creates Implication and Misunderstanding
Part 104 examined how positive terms such as “natural,” “healthy,” and “safe” can be understood more broadly than the assurance they actually provide. Ingredient origin, nutritional criteria, safety, environmental considerations, and certification status are separate dimensions. A single word does not prove all of them at once.
Consumers do not first encounter food through words alone. Product names, images of fruit or vegetables, background colors, leaf motifs, flags, certification-like symbols, differences in type size, and information placement begin shaping a hypothesis before the ingredient list or cautions are read: What kind of food is this? What does it contain? Where is it from? Is it healthy? Can it be trusted?
This is not an article about design taste. It is about the fact that nonverbal package elements can function as food representations. Each sentence may be accurate in isolation, yet the label can still fail if the combined presentation implies a different meaning.
A Package Is Not Merely a Collection of Information but an Order of Judgment
Consumers do not read words and design separately. Fruit imagery beside a product name may imply a major ingredient; green and a leaf symbol may imply broad environmental benefits; and a prominent flag and place name may suggest the origin of both ingredients and production.
A package therefore creates meaning not only through what is written but through what is noticed first, which elements are linked, and which conditions are postponed. Design is not decoration around information; it structures the order in which information is interpreted. If that order diverges from the facts, consumer understanding may diverge even when the technical information panel is accurate.
Regulation Does Not Examine Words Only in Isolation
Japan’s Act against Unjustifiable Premiums and Misleading Representations prohibits representations that lead general consumers to believe that the quality, standards, or other content of a product or service is significantly better than it actually is. The Consumer Affairs Agency explains that a representation can fall within this prohibition even when the misleading statement was made by mistake rather than intentionally. Consumer Affairs Agency: Misleading Representations Concerning Quality
In its guidance concerning health foods, the Consumer Affairs Agency states that potentially false or exaggerated representations are evaluated not only by isolated wording but by the impression and understanding consumers derive from the presentation as a whole. Even without explicitly saying that a product “reduces body fat,” images or video that create that impression may raise regulatory concerns. Consumer Affairs Agency: Considerations under the Premiums and Representations Act and Health Promotion Act for Health Foods
The U.S. Federal Food, Drug, and Cosmetic Act treats a food as misbranded when its labeling is false or misleading in any particular. In determining whether labeling is misleading, the law considers representations made or suggested by statements, words, designs, devices, or their combination, as well as the omission of material facts. 21 U.S.C. §343 21 U.S.C. §321(n)
EUR-Lex「Regulation (EU) No 1169/2011」
Article 7 of EU Regulation 1169/2011 likewise requires food information not to mislead consumers, particularly about the food’s nature, identity, properties, composition, quantity, country of origin or place of provenance, or method of manufacture. It also specifically addresses presentations that use appearance, description, or pictorial representations to suggest the presence of a food or ingredient normally expected to be present when that component has actually been substituted. EUR-Lex: Regulation (EU) No 1169/2011
A Brand Name and the Identity of the Food Must Be Considered Separately
eCFR「21 CFR 101.3」
Under 21 CFR 101.3, the principal display panel of a packaged food must bear a statement identifying the commodity. The name prescribed by law or regulation is used when one exists; otherwise, the common or usual name is used, and in its absence, an appropriately descriptive term is required. Giving the product a creative brand name and identifying its true nature are separate functions. eCFR: 21 CFR 101.3
Product teams may assume that a small food name beneath a large brand name is sufficient. Yet if the strongest front-panel wording evokes a different type of food and the accurate identity is hard to find, formal presence of the name does not necessarily produce consumer understanding. The name must be reviewed together with its size, proximity, contrast with the background, and relationship to surrounding imagery.
Fruit Images Can Say “Contained” Before the Ingredient List Is Read
Fruit photography is a convenient way to communicate flavor. Yet “tastes like this fruit,” “uses flavor derived from this fruit,” “contains juice from this fruit,” and “uses this fruit as a major ingredient” are not equivalent statements. An image can leap across these distinctions and create an immediate impression that the fruit itself is present in a meaningful amount.
Japan has a specific designation covering certain soft drinks and related products containing no fruit juice or pulp, or less than 5 percent. When the absence or low percentage is not clearly stated, the use of a fruit name in the product name, a fruit picture, photograph or design, or a color, aroma, or taste resembling fruit juice or pulp may constitute an unjustifiable representation. In this context, not only names and images but also color, aroma, and taste operate as representations. Consumer Affairs Agency: Representations Concerning Juice-Free Soft Drinks
eCFR「21 CFR 101.30」
U.S. regulation 21 CFR 101.30 similarly addresses beverages whose labels use fruit or vegetable names, vignettes, other direct or indirect representations, or color and flavor that make the beverage appear to contain juice. It requires a percentage juice declaration and, where no juice is present but the presentation suggests otherwise, a declaration such as zero percent juice or a statement that the represented juice is not contained. eCFR: 21 CFR 101.30
The practical question is not simply whether the pictured fruit appears somewhere in the formulation. Teams must identify whether it is present as juice, pulp, powder, extract, or flavoring, in what amount, and how accurately the front panel communicates that role. The task is not a binary “present or absent” check; it is to align the strength of the expectation with the ingredient’s actual function and quantity.
Colors Have No Universal Dictionary, but They Are Not Meaningless
There is no universal legal dictionary under which green means organic or blue guarantees safety. Yet a green background combined with a leaf motif and words such as “ECO,” “NATURAL,” or “PLANT” may connect environmental, naturalness, and plant-origin impressions. The issue is not color alone but the direction in which it amplifies other signs.
A Consumer Affairs Agency survey on environmental labels published in August 2026 examined 139 labels and found 59 for which the environmental feature being promoted was not externally clear, including cases without accompanying explanation. The summary gives an example of an “ECO” label with a leaf illustration but no concrete explanation of what aspect of the product is environmentally preferable. Consumer Affairs Agency: Survey Report on Environmental Labels—Summary
Environmental scope differs greatly depending on whether a claim concerns one packaging component, sourcing of a particular ingredient, a reduction during manufacturing, or the product’s entire life cycle. Enlarging the leaf symbol while minimizing the scope does not improve understanding. Identifying the subject, metric, percentage, or certification system near the symbol brings the impression closer to the evidence.
Flags, Place Names, and Landscapes Begin Telling an Origin Story
An origin impression does not arise only from an explicit “product of” statement. Flags, country outlines, famous buildings, regional names, foreign-language wording, traditional clothing, and farm landscapes can also suggest where a product or ingredient comes from. Recipe origin, brand origin, ingredient origin, and place of final manufacture are different facts, yet a package can cause them to be read as one story.
Japan’s designation concerning misleading country-of-origin representations addresses domestically produced goods that carry foreign country names, place names, flags, emblems, foreign business names, or predominantly foreign-language wording in a manner that makes domestic production difficult for consumers to recognize. It likewise addresses foreign-made goods presented with references to a different country that make the true origin difficult to identify. Consumer Affairs Agency: Misleading Representations Concerning Country of Origin
In the European Union, origin information is generally required where the label as a whole might otherwise imply a country of origin or place of provenance different from the true one. Where the origin of the food is voluntarily indicated and differs from the origin of its primary ingredient, the origin of the primary ingredient must be stated or identified as different from that of the food. Implementing Regulation (EU) 2018/775 provides the presentation rules. European Commission: Origin Labelling
Symbols Can Imply Third-Party Assurance More Strongly Than Short Words
When a genuine certification mark is used, the business should verify the certifying body, standard, certified scope, registration number, authorization for logo use, covered product or site, and validity period. For a company’s own mark, the name and visual form should avoid implying independent certification, while nearby wording should identify both the evaluator and the scope—for example, “company standard,” “applies to part of the packaging,” or “contains X% plant-derived material.”
This distinction is also essential when communicating organic status, halal certification practice, gluten-free positioning, vegan suitability, and environmental attributes. One certification does not automatically prove another attribute. Organic certification does not prove allergen absence; a gluten-free claim does not prove vegan suitability; and the use of a plant-derived ingredient does not by itself prove low environmental impact.
Type Size and Placement Matter as Much as Wording
The same words communicate differently depending on their position, size, and color. If “strawberry” appears prominently beside a fruit photograph while “flavored” or “1% juice” appears in small print on the back, the consumer’s first takeaway is not the qualification. Visual hierarchy effectively determines which message is treated as the main claim and which as a condition.
EUR-Lex「Regulation (EU) No 1169/2011」
Article 13 of the EU Food Information to Consumers Regulation requires mandatory information to appear in a conspicuous place so that it is easily visible and clearly legible. It must not be hidden, obscured, detracted from, or interrupted by other written or pictorial matter or intervening material. Important particulars cannot be allowed to disappear into the background in the name of visual elegance. EUR-Lex: Regulation (EU) No 1169/2011
eCFR「21 CFR 101.3」
U.S. regulation 21 CFR 101.3 likewise requires the statement of identity to be a principal feature of the principal display panel, presented in bold type and in a size reasonably related to the most prominent printed matter on that panel. As a brand name becomes more visually dominant, the food’s actual identity must retain corresponding visibility. eCFR: 21 CFR 101.3
The issue is not type size alone. Consumers must be able to connect a claim and its conditions within the same act of judgment. Information may formally exist yet fail to function when it is placed on a distant panel, blends into the background, uses technical language, or has no clear relationship to the symbol it qualifies.
A Global Design Can Contain Meanings That Are Not Global
Using one package design across many countries can improve artwork control, order volumes, inventory efficiency, and brand consistency. Yet the same image or color does not carry the same regulatory meaning in every market. Fruit imagery intended by a design team merely as a flavor cue may trigger percentage juice or characterizing-flavor requirements in the United States. In the European Union, it may raise questions about ingredient substitution or the origin of a primary ingredient.
Localization therefore does not end with proofreading translated text. The entire front panel—including the product name, photographs, illustrations, colors, flags, place names, symbols, and type hierarchy—must be reassessed through the destination market’s rules and consumer understanding. The back label may not be the only artwork that needs to change.
Label Review Should Examine Wording, Combination, and Hierarchy
Practical review begins with individual elements. Does the product name match the food’s true identity? Is the pictured material actually used? What origin does a flag or place name refer to? Does a symbol have a verifiable standard? Are nutrition, health, environmental, and certification messages substantiated? This is the review of factual truth at the level of words and assets.
The next step examines combinations. Does the combination of green, a leaf symbol, and a nature-oriented name imply organic or environmental status? Do a fruit image, fruit name, and red beverage color create a strong expectation about juice content? Do a flag, regional name, and farm photograph imply ingredient origin as well as manufacturing origin? This is the review of truth created by combination.
The final step examines hierarchy. Which words are largest? What would a person think the product is after three seconds? Is the qualification close to the claim? Is contrast with the background sufficient? Must the consumer search fine print on the back to correct the front-panel impression? This is the review of truth in the order of judgment.
Separate What the Package Guarantees from What It Invites Consumers to Imagine
A good package does not endlessly add explanation. It aligns the strongest impression with the most important facts. Consumers should not have to correct a large claim through small print. Images, colors, and words should help reveal the food’s identity rather than conceal it. This is the foundation of label design that prevents misunderstanding.
